In these Conditions of Sale "we" and "us" mean F D Imports Pty Ltd ABN 31 605 777 062  trading as The Stone Super Store of 16 Durham Road, Bayswater, WA 6053 Australia, and "you" means you the customer. These Conditions of Sale together with your Order constitute the entire Contract between us and you for the supply of Goods. The Contract cannot be varied unless we agree to vary it in writing or by email.

1) PRICES: All prices quoted include goods and services tax (“GST”).

2) QUOTATIONS:All quotes are valid for 7 days (due to currency fluctuations that can alter price).  On request we shall submit to you a revised quotation (with any necessary price updates).


    1. Payments can be made with cash, cheque, credit card or by direct deposit (EFT).  Please note if paying by cheque or EFT goods will not be released until funds have cleared in our account.
    2. We offer you a Lay-By service if you want to purchase goods, store in our warehouse and pick up at a later date.  A deposit 50% is payable to secure goods by Lay-By.  The balance of Lay-By is due no later than 12 weeks after the original sale date (regardless of whether goods have been picked up or delivered). 
    3. The balance of any invoice must be paid in full no later than 12 weeks after the original sale date (regardless of whether goods have been picked up or delivered). 
    4. Items which require Special Order (goods ordered specifically for you from local or overseas suppliers) need full payment at the time of placing an order. 
    5. The cutting of stone bench tops will not commence until the invoice is paid in full and a cutting sheet is completed, signed and returned to our staff.
    6. Goods need to be paid in full prior to pick up or delivery.

4) RISK AND TITLE: The title of goods supplied by us shall not pass to you until payment is received in full.


    1. Sorry!  Goods can only be stored in our warehouse for a maximum of 12 weeks.  Goods arriving from overseas commence storage date from the day they arrive in our warehouse. 
    2. Storage fees will apply if goods are held in the warehouse for more than the 12 week maximum period.  This fee will be charged weekly at a rate of 2.5% of the overall invoiced amount.
    3. Unfortunately goods not picked up within the 12 week period may go to a holding yard and delays in pick or delivery may occur. 


    1. Please present our staff with a copy of your invoice at the time of pick up.
    2. For bulky goods or large orders please call us in advance to notify our staff of your pick up.  This may save you lengthy wait time. 
    3. You are responsible for providing all packing ropes on Pick – Up.  We cannot take responsibility for goods not tied safely and secured at Pick-Up and onwards.
    4. An A-Frame is available for hire at $10 per half day. A $200 security bond is required to hire the A-Frame.  The bond will be refunded (less the hire charges) when the A-Frame is returned.
    5. You may require a pallet to transport goods.  You will be charged $20 for a new pallet and $10 for a second hand pallet.
    6. If you require goods to be double boxed you will be charged $20 per box.
    7. Sorry! A single item over 40kg cannot be loaded inside a vehicle (for WorkSafe reasons).  Goods over 40kg can be loaded onto the back of a Ute or into a trailer with assistance of our forklift.
    8. Please note Saturday trade is very busy and you may experience delays if picking up goods on this day.


    1. Delivery shall take place at our premises unless otherwise agreed. All costs incurred by us in effecting delivery to any other location shall be charged to you. 
    2. It is important that you provide us with the correct delivery address.  If the details are incorrect you will be charged for a second delivery. 
    3. Every effort will be made to comply with the indicated delivery date, but we will not accept responsibility for late delivery due to circumstances beyond our control.
    4. Metro delivery times can only be quoted as a.m. or p.m. deliveries.
    5. Metro deliveries of bulky goods (over 40 kg) are classed as a verge delivery only.  The truck hi-ab has a 3 metre reach and a 2.4 metre clearance (height).  The goods will be unloaded from the truck and placed on the verge.  You are responsible for removing goods from the verge.
    6. If you need to cancel or reschedule a metro delivery we require more than 2 working days notice.  There is no cancellation or rescheduling of deliveries with less than the required notice.
    7. For letterbox delivery and installation you must indicate to us where the letterbox is to be positioned (please use a marker).  If no marker is left we will determine the most suitable location.
    8. Non-Metro delivery times are an estimate only.  We use external freight carriers who only provide an approximate delivery time. 
    9. You are responsible for insuring goods requiring non-metro delivery (while in transit). 
    10. Please note you need to inspect delivered goods immediately (prior to signing for delivery) and notify us of any breakages or defects which you believe has happened during transportation.  We will not be liable for damaged goods that were not inspected by you on delivery. If you sign for a delivery clear and do not note any damage, no return will be authorised.
    11. You shall inspect delivered goods upon delivery and notify our staff within 14 days after delivery, of any respect in which you believe the goods do not meet consumer guarantees. You shall afford us an opportunity to inspect the goods within a reasonable time frame if you believe the goods are defective in any way.  If you fail to comply with these provisions the goods shall be presumed to be free from any defect or damage, and delivered in accordance with the contract.
    12. When you request us to deliver goods to an unattended location goods shall be left at your sole risk and it shall be your responsibility to ensure the goods are insured adequately or at all.
    13. Delivery dates stated by us for goods ordered from overseas are an estimate only.  We shall make every effort to deliver by that date but gives no other undertaking as to the date of delivery.  As a guide 12 – 14 weeks is the standard wait time for most goods ordered overseas (except paving which is a standard wait time of 6 – 8 weeks). 


    1. It is your responsibility for ensuring that goods to be purchased are fit for the intended purpose or purposes prior to placing an order. 
    2. There are no cancellations on goods which have been purchased using our Lay-By service. 
    3. There are no cancellations special orders (when goods are ordered for you from local or overseas suppliers).  Cancellation will result on forfeiture of any payments made on the order. 
    4. If, through circumstances beyond our control, we are unable to provide or deliver the goods, we may cancel your order by written notice.  On giving such notice we shall repay you any money paid in respect to the price.  We shall not be liable for any loss or damage whatsoever arising from such cancellation. 

9) RETURN OF GOODS:  We want you to be able to shop with confidence - nobody wants to be stuck with an item that they don't want. With The Stone Super Store, you won't be. 

    1. You can return or exchange an item that you bought from us for any reason within 30 days of receiving the item - no questions asked. If you decide to return your item then we'll refund the purchase price, less two delivery fees if applicable (to cover the outward and inbound delivery costs) and deduct a 1.5% Credit Card fee (if the original purchase was paid using a credit card)
    2. Some of our products can be offered with free delivery. If you return one of these products our actual delivery costs (both outbound and inbound) will be deducted from your refund.
    3. Goods must be returned to our premises in original condition and packaging so that we can endeavour to re-sell them.  We cannot pick up goods sent to a post office or holding depot.
    4. You are responsible for insuring returned goods as we do not accept liability for goods which are lost or damaged during transit.
    5. Discontinued, shop second, ex-display and sale goods are not eligible for return or exchange. 
    6. Goods returned after 30 days of purchase may be eligible for a credit note, less two delivery fees if applicable (to cover the outward and inbound delivery costs).
    7. Credit notes are valid for 90 days
    8. Goods returned after 90 days will not be eligible for credit or exchange.
    9. Used, damaged or otherwise altered goods are not eligible for return.
    10. There is no return on goods which are a special order (goods ordered specifically for you from local or overseas suppliers).
    11. There is no return on goods which have been purchased using our Lay-By service.


    1. Photographs, drawings, illustrations, weights, dimensions and any other particulars accompanying, associated with, or given in a quotation, descriptive literature or a catalogue, in relation to any product is given in good faith and is believed by us to be appropriate and reliable.  However, any photographs, drawings, illustrations, weights, dimensions and any other particulars accompanying, associated with, or given in a quotation, descriptive literature or a catalogue provided by us in relation to any product supplied by us is approximate only and may be subject to alteration without notice.
    2. We supply a range of goods which are natural products and / or made by hand (therefore no two pieces are the same).  We do not guarantee that each of these models will look identical to another of the same type.


    1. Any claim made under this warranty must be made within 14 days from the date of pick up or delivery.
    2. It is important that you retain your receipt as proof of purchase.
    3. You are entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
    4. Please notify us of warranty issues prior to installation.
    5. To make a claim under warranty we may request you send us a photo (if the goods cannot be returned within 14 days) so we can ascertain the problem with the goods purchased.  The warranty on a product will be void if the defect is a result of alteration, accident, misuse, abuse or neglect. 
    6. Our goods come with guarantees which cannot be excluded under the Australian Consumer Law (Competition and Consumer Act 2010)
